Terms and Conditions for Website Design and Subscription Services
This Agreement (“Agreement”) is entered into between Colorbull Llc. (“Colorbull Agency”), with a business address at 1314 E Las Olas Blvd, Suite 2534, Fort Lauderdale, FL 33301, and the customer, collectively referred to as “Parties.”
Summary:
By engaging Colorbull Agency for website design and development services, the customer agrees to the terms and conditions outlined in this Agreement. The customer acknowledges their authority to enter into this contract on behalf of their company or organization and agrees to provide all necessary materials and feedback in a timely manner. The Parties agree to adhere to the payment schedule and timelines specified below.
Details of the Works:
Colorbull Agency will create website designs and layouts, including one main design and two revision opportunities. HTML/CSS development will be compatible with major browsers. The customer is responsible for providing text and photographs unless otherwise agreed upon. Stock photography and additional content creation may result in extra charges.
Changes and Revisions:
The provided estimate/quotation is based on agreed-upon specifications. Any changes, additional pages, templates, or functionality requests will result in additional quotes and timelines.
Technical Support:
The provided quote includes site setup and implementation of Google Analytics. The customer is responsible for server/hosting management if not hosted by Colorbull Agency. Technical support for third-party services is not included.
Legal:
Colorbull Agency is not liable for damages or operational issues of the website. Invalid provisions of this Agreement do not affect the validity of remaining provisions.
Copyrights:
The customer guarantees ownership or permission for the provided content. Upon final payment, the customer owns graphics, text content, and photographs provided by Colorbull Agency. HTML/CSS code remains owned by Colorbull Agency, with limited licensing to the customer for the project.
Payment Terms:
Subscription Payments: All subscription payments are to be remitted on a monthly basis in accordance with the recurring billing cycle. Payments that are not received within 5 days of the due date will lead to the temporary suspension of services. In the event that payments remain overdue for more than 30 days, Colorbull Agency reserves the right to terminate all agreements associated with the services. This termination may include the removal of websites and materials governed by the respective agreement.
Per Project Costs: For projects billed on a per-project basis, a 50% deposit is required to initiate the project. A detailed payment schedule will be established and documented in a signed contract. Adherence to this schedule is essential to ensure the timely completion of the project. Failure to make payments in accordance with the agreed-upon schedule may result in project delays or adjustments to the scope of work.
The payment terms outlined above are designed to ensure transparency and maintain the integrity of our services. By proceeding with our services, you acknowledge and agree to these payment terms. For any clarification or queries, please don’t hesitate to contact us.
Interest accrues if payment is more than 14 days late. A 5% increment is added every 7 days starting from the 15th day after receipt of the finished product.
Initial Payment & Refund Policy:
No refunds will be provided unless requested in writing within 24 hours of purchase. Cancellations requested will continue to run until the end of the subscription term.
By continuing with any purchase of website design and subscription services, the customer acknowledges and agrees to these terms and conditions.
